If the acquirer cannot directly exclude the possibility that this constitutes a legal transaction that is subject to licensing obligations, then he must contact the competent licensing authority for:
- a permit or
- a declaration that there is no obligation to obtain a permit.
In the case of legal transactions that are subject to licensing obligations, these may not be executed without a legally-valid permit
- entry in the land register
- acquisition outside the land register (e.g. transfer of shares).
